COMM 341: Facts in cases

  • There are three kinds of facts:
    • True facts
      • That which really did happen (what you assume facts to be)
    • Alleged facts
      • "Version" - your version of what happened.
    • Proven facts
      • Facts as found by the trier-of-fact (jury, judge, etc)

Trial process:

  • 1. Case starts with both parties alleged facts
  • 2. Facts are evaluated by evidence at trial (CLOSED BUBBLE SYSTEM)
  • 3. Proven facts are found
  • 4. Remedy is then found, considering ONLY proven facts.

NOTE: TRUE FACTS (or reality) ARE IGNORED
