COMM 341: Facts in cases

- There are three kinds of facts:
- True facts
- That which really did happen (what you assume facts to be)
- Alleged facts
- "Version" - your version of what happened.
- Proven facts
- Facts as found by the trier-of-fact (jury, judge, etc)
- True facts
Trial process:
- 1. Case starts with both parties alleged facts
- 2. Facts are evaluated by evidence at trial (CLOSED BUBBLE SYSTEM)
- 3. Proven facts are found
- 4. Remedy is then found, considering ONLY proven facts.
NOTE: TRUE FACTS (or reality) ARE IGNORED
