You can subsitute cause of action for count here.

  • In multiple count lawsuits, you get the best compensatory and punative but you DON'T double count. EG. if you get $25,000 com for breech account and $5,000 comp / $20 M Pun.
    • You get $25,000 comp and $20 M pun.

Different acts

  • Different acts can easily be different counts

Same act, different causes of action

  • Example:
    • Someone promises to do something and does not - can sue for:
      • Breech of contract has NO PUNATIVE DAMAGES
      • Tort of Fraud (has punative damages)
