Principle of Estoppel
- Estoppel principle (Ratti case)
- Member States should not have any advantages from of its wrongdoing – or no horizontal direct effect among citizens (see cases Marshall II, Faccini Dori) (but vertical effect)
- State is in breach of its obligation of Art. 249 EC and Art. 10 EC
